Driving lesson cancellations

The pupil must give a minimum of 24 hours’ notice to the instructor to cancel or reschedule any booked driving lesson. If less than 24 hours' notice is given the full lesson fee will still be charged.

Please remember, when booking a driving lesson the pupil is reserving a specific period of time in the instructors scheduled working diary and it is not usually possible for the instructor to fill this time at short notice, hence the requirement to charge the full amount for all lessons cancelled within this 24 hour period.

Your driving instructor and the tuition vehicle

The driving instructor is a fully-qualified Driving Standards Agency Approved Driving Instructor and is licensed by the Driving and Vehicle Standards Agency to provide driving tuition. The driving instructor is bound by a professional code of conduct and will be courteous, polite and punctual and behave in a professional and ethical manner at all times.

The instruction vehicle is fully insured for the purpose of driving tuition and will be clean, tidy and well maintained. The vehicle is fitted with He-Man dual controls.

Driving licence, eyesight and wellbeing

The pupil must hold a valid driving licence (provisional or full), which must be produced on or before the first driving lesson. The pupil must also prove their entitlement to drive by either creating a licence check code or by providing their National Insurance Number and allowing the instructor to check their entitlement to drive electronically. Pupils must inform the instructor immediately if they receive any endorsements on their driving licence during the period they are receiving tuition.

The pupil must be able to read a number plate at a distance of 20.5 metres (whilst wearing glasses or contact lenses if normally worn). The instructor reserves the right to cancel the lesson if the pupil fails this test.

To ensure the safety of the pupil, the instructor and other road users, the pupil must inform the instructor if they believe they are suffering from any health conditions – physical or mental – that will negatively impact on their ability to drive safely. The instructor reserves the right to cancel a lesson if they suspect the pupil is under the influence of drugs and/or alcohol, or if they believe the pupil to be unfit to drive for any health related reason. If this occurs the lesson fee will still be charged.

Arranging driving lessons and learner punctuality

The time, date and duration of all lessons will be arranged and agreed directly between the pupil and the instructor, either in person, by SMS or by email. The lesson will begin and end from the pupils home address unless arranged otherwise. Changes to pick-up/drop-off locations require 24 hours notice. Any changes must fall within the the areas covered by the driving instructor.

It is expected that the pupil will take lessons on a regular basis, typically at least one lesson per week.

Pupils are advised to be punctual for their lesson appointments. If the pupil arrives late the lesson may still have to finish at the previously agreed end-time if the instructor has another lesson to attend.

The instructor will be available outside the pupils address at the agreed start time and the pupil should expect the lesson to start at this time. The instructor will not contact the pupil at the start of each lesson if they have arrived on time and are positioned within view of the starting address. The instructor will only attempt to contact the pupil in the event of a delay to the agreed start time, or if it has not been possible to park within eyesight of the pupils address.

In the event of a 'no-show' by the pupil, the instructor will normally wait for a period of 15 minutes after the agreed start-time before the lesson would be abandoned. The lesson fee will still be charged if the lesson is abandoned due to a 'no-show' by the pupil.

A reciprocal waiting time may become necessary if the instructor is delayed due to unforeseen circumstances. Where possible any lesson time lost as a result of a delayed start would be made up by the instructor either at the end of the normal lesson time, or added on to a subsequent lesson. If for any reason outside the instructors control it is not possible to deliver the full lesson duration, any remaining time will be added to a subsequent driving lesson.

Driving lesson payments and refunds

Lesson payments can either be made electronically by bank-transfer or by cash paid directly to the the instructor.

All electronic bank-transfer payments must be made no later than 60 minutes prior to the agreed start-time of the lesson. If electronic payments are not received by this time the instructor reserves the right to cancel the lesson.

Cash payments should be made at the start of the lesson.

Refunds of partial block bookings will be made on a pro-rata basis. Lessons taken will be charged at the full hourly-rate and the difference will be refunded.

Pre-paid lessons must be taken within six months of the payment being made.

Driving lesson postponements

The instructor reserves the right to postpone lessons in certain circumstances, such as dangerous weather conditions, unsafe roads, mechanical breakdown or illness. In the event of postponement, lesson fees paid in advance will be carried forward. The instructor cannot be held responsible for any costs incurred as a result of having to postpone any lessons, for whatever reason.

The driving test

Driving test bookings always take priority over standard lesson bookings, therefore it may occasionally be necessary to rearrange a booked lesson to allow the instructor to attend a driving test. Changes to lesson bookings as a result of this will be notified immediately and where possible an alternative lesson will be suggested.

Driving test bookings must be notified to the instructor as soon as they are known, otherwise the instructor cannot guarantee to provide a vehicle for the test. Pupils should always confirm the availability of the instructor before booking a practical driving test. If a pupil fails to do this and the instructor has a prior commitment at the time of the booked test, then the instructor will not be able to accompany the pupil to the test or provide a vehicle. The instructor cannot be held responsible for any costs incurred as a result of having to cancel a test in this situation.

The 'Test Fee' payment made when booking a practical driving test is made directly to the DVSA. The driving instructor will also charge a fee on the day of the test to cover the cost of the lesson prior to the test, the use of the tuition vehicle for the purpose of the test, and the time spent travelling to and from the test centre. The test day fee payable to the driving instructor on the day of the test is equivalent to a two hour lesson.

In the interests of safety the instructor reserves the right to withhold the use of the car for the purpose of the test, if, in the opinion of the instructor, the pupil has not reached the necessary test standard, or if their driving is considered to be actually or potentially dangerous. The instructor will always attempt to give three working days' notice in such cases, however if the pupil cancels or fails to take previously agreed lessons in the days prior to the test it may not be possible to provide three working days' notice. FOX Driver Training cannot be held responsible for the loss of the test fee or any further costs incurred as a result of having to cancel a test in this situation.

The instructor cannot be held responsible for any postponement or cancellation of driving test appointments made by the DVSA. Such cancellations are beyond the control of the driving instructor and therefore the full 2 hour lesson fee for the booked ‘test-day’ lesson will still be charged if the test is cancelled with less than 24 hours notice. Your instructor will advise you about claiming expenses from the DVSA.

The instructor will make every effort to ensure that the vehicle supplied for test will be fully roadworthy and comply with all legal requirements at the start of the test, your instructor cannot be held responsible for vehicle failure that occurs during the test and is not liable for consequential loss.

Your Statutory Rights

The pupil agrees to the terms and conditions stated above, this being recognised by paying for the driving lessons at the present rates as shown in the pricing section.
